LAS VEGAS, Sept. 15, 2026 /PRNewswire/ — This Release is being circulated to address MPS’s statements, including those made to customers of Parking Revenue Recovery Services, Inc. (“PRRS”) and others attending the 2026 NPA Conference and Expo.

Status of asserted patent claims

In June 2025, MPS filed a complaint against PRRS asserting five counts of patent infringement. MPS’s 2025 case is dormant, as the court ordered a stay pending the outcome of five pending Reexamination Proceedings before the United States Patent & Trademark Office (“USPTO”).

As of today, four of MPS’s asserted patents have received a Final Rejection issued by the USPTO. More specifically, MPS’s patents have been reevaluated based on substantial new questions of patentability that the USPTO had not considered before, which include every asserted claim of U.S. Patent Nos. 11,257,302, 11,688,205, 12,142,085 and 12,249,187. In other words, the USPTO has determined that all asserted claims of these four patents are invalid – a claim PRRS has maintained throughout MPS’s case.

Despite these Final Rejections, MPS filed a new complaint against PRRS in July 2026, raising a sixth patent, U.S. Patent No. 11,688,734. Due to the USPTO’s determination of invalidity of MPS’s prior patents, and the existence of substantial new questions of patentability, PRRS initiated a Reexamination Proceeding against the ‘734 Patent in August 2026.

In addition to these issues of invalidity, PRRS does not infringe upon any of MPS’s patents, including U.S. Patent No. 11,688,734. MPS’s prior statements to others in the parking industry have lead to an extensive countersuit by PRRS, which seeks: Judgment of Non-infringement; Judgment of Invalidity; Judgment of Unenforceability; Federal Unfair Competition; Intentional Interference with Contract; and Civil Conspiracy (among MPS and Premium Parking).1 If and when the 2025 case reopens, PRRS will vigorously pursue these remedies to address MPS’s conduct, including MPS’s continued enforcement of invalid patents.
